Acceptance of Terms
By accessing or using Uptime Monitor ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including visitors, registered users, and paying subscribers.
We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms.
Account Registration & Security
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate information — Your registration details must be truthful and current.
- Maintain security — You are responsible for safeguarding your password and account credentials.
- Notify us of breaches — You must immediately notify us of any unauthorized access to your account.
- Account responsibility — You are responsible for all activities that occur under your account.
We strongly recommend enabling two-factor authentication (2FA) for additional account security.
Service Description
Uptime Monitor provides the following services:
- Uptime Monitoring — Automated checks for HTTP(S), Ping, Port, DNS, SSL, Keyword, Heartbeat, Domain Expiry, and Change Detection monitors.
- Alert Notifications — Real-time alerts via Email, Slack, Discord, Telegram, Microsoft Teams, Google Chat, PagerDuty, Webhooks, and Zoho Desk.
- Public Status Pages — Customizable status pages to communicate uptime to your users and stakeholders.
- Incident Management — Automatic incident creation, tracking, acknowledgment, and resolution workflows.
- Diagnostic Tools — SSL checker, DNS lookup, security headers analyzer, and other free tools.
Acceptable Use Policy
You agree not to use the Service for any unlawful or prohibited purpose. Specifically, you must not:
- Abuse the platform — Do not use the Service to perform denial-of-service attacks, stress testing, or any form of network abuse.
- Monitor without authorization — Do not monitor URLs, servers, or services that you do not own or have explicit permission to monitor.
- Illegal activity — Do not use the Service to facilitate any illegal activities, including monitoring targets for malicious purposes.
- Circumvent limits — Do not create multiple accounts to bypass plan limits or restrictions.
- Interfere with the Service — Do not attempt to disrupt, reverse-engineer, or compromise the platform infrastructure.
Pricing & Payments
- Free Plan — We offer a free tier with limited monitors and features. No credit card is required.
- Paid Plans — Premium plans are billed on a monthly or annual billing cycle as displayed on our pricing page.
- Plan Changes — You may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle.
- Refunds — We offer refunds on a case-by-case basis within 7 days of purchase. Contact support for refund requests.
- Price Changes — We may adjust pricing with at least 30 days advance notice. Existing subscriptions are honored until renewal.
Service Availability
We strive to maintain 99.9% platform uptime for our monitoring infrastructure. However, this is a target, not a guarantee. The Service may be temporarily unavailable due to:
- Scheduled maintenance (announced in advance when possible)
- Emergency security patches or critical updates
- Force majeure events beyond our reasonable control
- Third-party service provider outages
We will make reasonable efforts to notify users of planned downtime and to restore service as quickly as possible during unplanned outages.
Limitation of Liability
To the maximum extent permitted by law, Uptime Monitor and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or data arising from your use of the Service
- Damages resulting from missed or delayed alert notifications
- Downtime or data loss caused by factors outside our control
- Any unauthorized access to your account due to compromised credentials
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
Either party may terminate the relationship at any time:
- By You — You may delete your account at any time from your account settings or by contacting us.
- By Us — We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay for a paid subscription.
- Effect of Termination — Upon termination, your access to the Service will cease. Your monitoring data may be deleted after a 30-day grace period.
Changes to Terms
We may modify these Terms of Service at any time. When we make significant changes, we will:
- Update the "Last updated" date at the top of this page
- Send an email notification to registered users for material changes
- Display a notice on the platform dashboard
Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.
